Terms of Sales

Article 1. Offer

By signing the price offer, the customer formally acknowledges to heve read these terms and conditions and accepts them without reservation. Any price offer signed by the customer, for agreement, represents a firm and final order. Any modification thereof is subject to Article 6 of these conditions.

Article 2. Orders

All orders will be billed. Orders placed via Internet are validated by e-mail exchange. Oral or telephone orders will be discontinued. Unless otherwise stipulated in writing on the order, the following procedure for the financial settlement of the order applies:

  • A deposit of 20% of the total price of the order must be paid to Gastron'Home SPRL to reserve the date in its calendar and this, at the latest within the 10 days (calendar days) which follow the date of the order . This deposit is not refundable any longer and is subject to Article 5 of these conditions.
  • A deposit representing 30% of the total amount must be paid to Gastron'Home SPRL at least 15 days (calendar days) before the date fixed for the service.

The balance of the order must be paid to Gastron'Home BVBA

  • Either in cash, on delivery, against acknowledgement of the invoice;
  • Or by bank transfer, within 8 days (calendar days) following the billing date.

In case of late payment of a deposit, Gastron'Home SPRL reserves the right to suspend all orders in progress, without prejudice to any other action. Any amount unpaid on the due date and mentioned on the invoice will, by right and without prior notice, be subject to a late payment interest of 10% per annum. In addition, a late payment of 12% of the amount due might be required.

Article 3. Price

Unless otherwise stipulated in writing on the order, the prices mentioned include the purchase of all ingredients, culinary preparations and the dressing of dishes or plates (depending on the type of order). The prices mentioned are in Euros and are exclusive of VAT. These are the prices corresponding to the rate applicable on the day of the quote; they are valid for 30 days (calendar days) following the date of their establishment. At the end of this period, prices may be revised according to seasonal product prices, economic conditions or any other factors that might influence purchase costs. Other options, services and / or services (personal or otherwise) will be subject to separate rates and additional charges.

Article 4. Payment

Payment must be done in cash and without any discount.

Article 5. Delivery and transport costs

Shipping and / or delivery costs will be charged extra. For any delivery, transport or service, charges are calculated from B-6743 Buzenol. The calculation is based on the number of kilometers (round trip) x 0.30 €. Unless otherwise stipulated in writing on the order, these expenses include all the trips necessary for the proper organization of your event, including the trips necessary for the return of material. Shipping costs are in Euros and exclude VAT.

Article 6. Modification and cancellation of the order

Any request for modification (except partial or total cancellation) to the order must reach us, in writing, at the latest within 8 days (calendar days) which precede the delivery date. Beyond this deadline, Gastron'Home SPRL reserves the right to refuse the request for modification of the client; the initial order remains valid and its amount remains billable in its totality. In case of partial / total cancellation (including the number of guests), Gastron'Home SPRL reserves the right to charge the customer, as compensation, the following amounts:

  • In all cases, the minimum amount corresponding to 20% of the total price of the order.
  • For any cancellation sent within 15 days (calendar days) preceding the service, the amount corresponding to 50% of the price of the order.
  • For any cancellation sent within 8 days (calendar days) preceding the service, the amount corresponding to 75% of the price of the order.
  • For any cancellation sent within 3 days (calendar days) preceding the service, the full amount of the order.

Article 7. Liability and guarantees

Gastron'Home SPRL undertakes to provide the service according to the provisions on the customer's order and makes every effort to provide the products ordered in due time. However, favoring the use of fresh products, the dishes initially planned are likely to vary according to the market. In this situation, Gastron'Home SPRL will propose to the customer, as far as he wishes, to replace the products ordered by comparable products of the same quality. As a matter of right, the customer is free to refuse the proposals made, without it causing him additional costs. Gastron'Home SPRL could be released from its obligations or suspend its execution if it were unable to assume them due to a case of force majeure (war, riot, demonstrations, strikes, exceptional weather conditions, disaster affecting the facilities of its establishments, ...). Any cancellation by Gastron'Home SPRL of the ordered service will result in the reimbursement of the deposit paid by the customer, excluding any other compensation. Any case or non-misconduct on our part that might stop, suspend or interrupt the performance of a contract is reserved for our benefit and disclaims any liability in the same way as a case of force majeure.

Article 8. Claims

Any complaints relating to quality or any breach must be sent by registered letter within 3 days (business days) following the date of receipt of the delivery. Once this period is exceeded, each delivery is considered as being in accordance with the order.  Gastron'Home SPRL declines all responsibility in case of theft, loss, degradation of the effects belonging to the customers and / or to the participants that could occur during the performance. For this purpose, the customer agrees to waive and makes its insurers to waive any claim against Gastron'Home BVBA. Therefore, the customer guarantees the company against any recourse that may be engaged by the participants. Gastron'Home BVBA also disclaims its responsibility in case of non-respect of Sabam's rights or other taxes due by the client during the performance.

Article 9. Hygiene and allergen standards

Gastron'Home BVBA respects and applies HACCP principles and current legislation. In the event that the delivered product is not consumed upon receipt, the customer will take care to respect the required storage conditions. Gastron'Home BVBA will not assume any liability resulting from the poor storage of products after delivery. For legal health reasons, foodstuffs exposed on buffets and not consumed will be discarded. Gastron'Home BVBA declines any responsibility if these goods are nevertheless carried away, the chain of the cold being broken. All dishes are made in a workshop using gluten, crustaceans, eggs, fish, peanuts, soy, milk, nuts, celery, mustard, sesame, sulphites, lupine and molluscs. Gastron'Home BVBA cannot guarantee the total absence of traces of these various allergens in its workshop. Gastron'Home BVBA therefore draws the customer's attention to the potential risks of allergic reactions related to the consumption of his meals. The customer is responsible for relaying this information to his guests. Any allergic guest being informed of this risk by the customer is aware of the potential danger associated with the consumption of food made by Gastron'Home BVBA. In this case, the customer must mention, in writing, on the order form, any known allergies among his guests. Gastron'Home BVBA has the right to refuse the distribution of food to people at risk.

Article 10. Personal Information

The personal information of the customer transmitted to Gastron'Home SPRL are confidential and are not transmitted to any third party. They are used exclusively to improve the quality and personalization of the Gastron'Home BVBA service as well as for the formalization of commercial proposals. The customer can always consult his personal data recorded by Gastron'Home SPRL by sending him a written request. If this data is incorrect, incomplete or irrelevant, he / she is invited to communicate it in writing to: Gastron'Home BVBA, 29 Chemin d'Etalle B-6743 Buzenol.

Article 11. Litigation

Any dispute relating to the interpretation or execution of these conditions will be the exclusive jurisdiction of the Court of Arlon.

Article 12. Applicability to consumers

The present conditions are applicable to private consumers only insofar as they comply with the provisions of the law on commercial practices.
